摘要
对法理之“理”的理解,我们长期依靠西方术语体系也让我们长期囿于西方思维体系,以致对其内涵与体系的理解总是难以突破,从汉字语义视角或许能得到一些思想启迪。从汉字语义上看,法理之“理”可以包括“法之道理”和“法之机理”两个方面。前者是指法获得其自身属性、现实特质的内在规定性与价值取向,后者是指法得以存在、运行的具体条件与内外机制。法理学可以从这两个维度,建构、优化自身的理论体系。
For the understanding of the“theory”of jurisprudence,Chinese scholars have relied on the western terminology system for a long time,thus confining to the western thinking system.The understanding of its connotation and system is always difficult to break through.However,it may be enlightened by some thoughts from the perspective of Chinese character semantics.From the semantic point of view of Chinese characters,the legal principle can be divided into two aspects:the truth of law and the mechanism of law.The former is the intrinsic stipulation and value orientation of referential law,and the latter is the concrete condition and internal and external mechanism of the existence and operation of referential law.Jurisprudence can construct and optimize its own theoretical system from these two dimensions.
