农村房屋买卖合同效力的司法判决研究

摘要 通过研究法院审理农村房屋买卖合同纠纷的275份终审判决书,归纳、分析法院认定的有效类型、无效的理由以及无效后的房屋处理模式与赔偿损失的范围,发现认定无效合同存在无效的法律依据不当、责任承担与损失认定的不一致、与赔偿请求权诉讼时效适用的不一致和与无效判决存在明显冲突等问题。在此基础上建议,重新审视农村房屋买卖合同无效的法律依据,延伸有效合同的类型,调整责任划分与损失认定,构建有效合同的非同一集体成员取得房屋及宅基地使用权制度。 Through studying the 275 final judgments of rural house sales contract disputes heard by the court and through the induction and analysis of the valid cases with judicial recognition,invalid reasons,the processing mode afterwards and the scope of compensation for loss,it is found that the legal basis for determining the invalidity of the contract is improper,liability bearing is inconsistent with loss evaluation and application of the limitation of action of the right to claim indemnity and is contradictory with the invalid judgment.Accordingly,it is suggested to reexamine the legal basis of the invalid rural house sales contracts,expand the type of valid contracts,adjust the responsibility identification and evaluation of loss,and construct the system that non-collective members can obtain the use right of house and homestead according to valid contracts.
