摘要
助贷业务存在客户支持、资金支持和风控支持三种基本模式,其发展建立在"比较优势理论"和"金融功能理论"的基础上,符合经济发展和金融演进的规律,也有助于推动普惠金融发展、改变银行同质化竞争、完善信贷业务模式和风险控制。近年来,助贷业务的经营模式出现了异化走样,违规发放贷款、核心业务外包、违规跨区域经营、信息收集使用不规范、非法暴力催收等问题和风险不断暴露。对此,针对助贷业务的监管政策也在不断出台,涉及助贷机构资质、授信风控、信息保护、逾期催收等多个方面,基本涵盖了贷前、贷中、贷后全过程。未来,助贷业务仍具有较大发展空间,但其健康稳健发展需要市场主体和监管部门之间的良性互动:各业务主体需要进一步恪守助贷实质,加强合规管理,聚焦科技赋能;监管政策需要明确鼓励创新与防范风险并重的监管取向,促进监管政策和责任权限的统一,实现刚性底线和柔性边界的并重。
Based on the basic models and theories of co-nancing,this paper studies the potential risks of co-financing and the regulatory responses.Co-financing has three basic operation models:customer support,fund support,and risk control support.Its development is based on the comparative advantage theory and the functional perspective of nance,ts the economic development and nancial evolution,and is helpful to promote inclusive nance,improve homogenous competition between banks,and perfect lending business and risk control.However,co-nancing has gone astray in recent years.The problems and risks such as lending against regulation,outsourcing core business,inter-regional operation against the law,data collection with improper ways,violent collecting of loans,and so on,have been exposed.In response,regulatory policies have been imposed on co-financing which have basically covered the whole process:before,during and after the lending.Co-financing still has great potential to develop,but its healthy development requires the benign interaction between market participants and regulatory authorities.Market participants should follow the regulation,strengthen compliance management,and focus on the technology nature.Regulatory authorities should adopt the policy line which promotes innovation and controls risk at the same time,so that to unite the responsibility with regulatory policy,and realize the combination of a hard bottom and a soft boundary.
