摘要
试图构建一个社区治理现代化的中国逻辑总体性理论。首先,在梳理治理与现代化理论基础上,提出中国社区治理现代化的理论逻辑,即由一系列制度安排为内涵的社区治理体系现代化和由主体性能力为内涵的社区治理能力现代化共同构成,并给出了社区治理现代化概念;其次,从法的本源性视角研究,认为社区治理现代化需依赖群众性自治组织与基层政权两个社区元属性及其派生性的实践逻辑结构为介质实现其现代化。最后,从社区治理现代化实践逻辑结构的制度性主体、治理技术、社区居民3个层面论述其实现现代化的实现路径,从而推动社区治理现代性要素不断从低级向高级变革,最终实现社区治理现代化。
The paper constructs a general theory of community governance modernization in China. Firstly, on the basis of reviews over the theories of governance and modernization, it puts forward the theoretical logic of community governance modernization in China, which consists of the modernization of community governance system with a series of institutional arrangements as its connotation and the modernization of community governance ability with the subjectivity ability as its connotation. Afterwards, it puts forward the concept of community governance modernization. Secondly, from the perspective of the origin of law, it considers that the realization of practical logic of community governance modernization relies on two community meta-attributes and their extensibility: mass self-governing organizations and grass-roots political power. Finally, the paper discusses the way to realize community governance modernization from three aspects of the logical structure of community governance modernization practice as follows: institutional subject, governance technology and community residents, thereby promoting the transformation of modernity elements of community governance from low-level to high-level, and ultimately to realize the modernization of community governance.
