浙江省电子商务专利侵权保护模式研究 被引量:1

摘要 浙江省是领跑全国的电商大省,全国约有80%的网络零售在浙江的电商平台上完成。电商领域的知识产权侵权案件频发,这也是浙江知识产权保护领域的一大特色和难点。目前国内有关这一领域的研究相对滞后,国外也没有成熟、一致的规制模式可供借鉴。本课题基于2015年杭州市专利发展现状和2016年淘宝网部分专利侵权案例数据等进行研究。一是发达国家和国内电子商务专利侵权保护模式现状进行分析。二是深入研究浙江省电子商务平台专利侵权与保护模式现状。三是基于淘宝(中国)网站100件专利侵权案例数据进行分析研究,总结得出浙江省电子商务专利侵权特点。四是分析浙江省电子商务平台专利侵权与保护模式存在问题。五是提出浙江省电子商务平台专利侵权与保护模式发展对策。 Zhejiang Province is the biggest Electronic Commerce area in China,about 80%of online retail sales are completed on the e-commerce platforms in Zhejiang Province.Due to the huge transaction,the intellectual property infringement cases in this field frequently happened,which is also a major feature and difficulty in the field of intellectual property protection in Zhejiang.At present,the research on this field in China lags behind and there are no mature and consistent regulatory models in other countries for reference.This subject analysed the status quo of patent development in Hangzhou in 2015,and compares the protection model of patent infringement in developed countries with the patent data of some patent infringement cases in Zhejiang Intellectual Property Service Centre in 2016.Firstly,we analyzed the current situation of patent infringement protection mode in developed countries and domestic e-commerce.Secondly,we deeply studied patent infringement and protection of the status quo the on ecommerce platform in Zhejiang province.Thirdly,based on the analysis of 100 cases of patent infringement on the website of Taobao(China),we found the patent infringement characteristics of ecommerce in Zhejiang Province.Fourthly,we analysed the problems of patent infringement and protection mode of Zhejiang e-commerce platform.Finally,we put forward Zhejiang Province e-commerce platform patent infringement and protection mode development countermeasures.
