摘要
图形用户界面是一种结合了计算机科学、美学、行为学的新设计,本质上应当是一种表达,而非技术方案。图形用户界面在授权条件、侵权判定标准、条件等方面与专利法存在着很大的差异,图形用户界面虽然具有实用性,但是,该实用性也完全不同于专利法中规定的实用性,采用专利法的方式对其进行保护将不利于图形用户界面的发展,也会导致专利法内部的不协调。未来的图形用户界面必然不再依靠有形产品,设计将成为其最重要的部分,在国际立法潮流和产业利益的推动下,外观设计将会单独立法,而基于本质上的一致性,图形用户界面也将因此实现更高水平的保护。
Graphical user interface is a new design that combines computer science,aesthetics,and behavior.It should be an expression,not a technical solution.The graphical user interface differs greatly from the patent law in terms of authorization conditions,infringement criteria,conditions,etc.Although the graphical user interface is practical,the practicality is completely different and the practicability specifi ed in the patent law is adopted.The way the patent law protects it will not be conducive to the development of the graphical user interface,and will also lead to internal coordination in the patent law.The future graphical user interface will no longer rely on tangible products,design will become its most important part,driven by the trend of international legislation and industrial interests,the design will be separately legislated,based on the inherent consistency,graphical user interface A higher level of protection will also be achieved as a result.
