京津冀地区纠纷解决机制的司法流程再造——以诉源治理推进纠纷“一站式”多元解决为视角 被引量:6

摘要 近年来,人民法院尤其是京津冀地区法院的案件受理数持续攀升,涉互联网新类型纠纷尤甚,因此,与其相适应的新的解决纠纷流程成为社会公众的新需求。在此背景下,京津冀三地法院将纠纷解决机制与信息化深度融合,依托司法人工智能将办案模式从线下逐步移转至线上,使部分案由案件的诉前分流、立案、审判、执行通过全流程在线“一站式”的方式解决,是对京津冀三地法院传统审判方式的一次革命性的流程再造。在此背景下,人工智能技术应用下的案件纠纷解决机制司法流程再造的大致过程进行了应用效能前瞻,通过对“诉讼前端”、“诉讼中端”、“诉讼后端”的全流程“网上案件网上审”,形成互联网时代背景下京津冀三地法院的“新枫桥经验”。 In recent years,the number of cases accepted by the People's Courts,especially the Beijing-Tianjin-Hebei Region Court,has continued to rise,especially in new types of Internet-related disputes.Therefore,the new process of dispute resolution has become a new demand of the public.In this context,the courts in Beijing-Tianjin-Hebei region have deeply integrated the dispute resolution mechanism and information technology,relying on the judicial artificial intelligence to gradually transfer the case handling mode from offline to online,so that some cases can be solved through the whole process of online one-stop mode,which is a revolutionary process for the traditional trial mode of the courts in Beijing-Tianjin-Hebei Reengineering.In this paper,the application efficiency of the judicial process reengineering of the case dispute resolution mechanism under the background of artificial intelligence technology is prospected.Through the whole process of“online case online trial”of“litigation front end”,“litigation middle end”and“litigation back end”,the“new Fengqiao Experience”of the courts in Beijing-Tianjin-Hebei region under the background of Internet era is formed.
