摘要
检察机关公益诉讼以保护国家利益和社会公共利益为根本目的。在公益诉讼如火如荼开展之际,行政公益诉讼诉前调查利益受损状况如何、相关单位整改情况是否到位、提起诉讼的标准如何界定等问题涉及复杂的专业知识。鉴于检察机关"运动员"和"裁判员"的双重身份,考虑到公益诉讼中诉讼请求的确定、因果关系的确定等有诸多专业工作的需要,引入第三方代表评估机制,积极借助外脑外力,成为增强公益诉讼工作的科学性、专业性、客观性的重要举措。
Public interest litigation filed by the procuratorial organs pursues for the interest of our country and the society.At a time when public interest litigation is in full swing,we should solve some professional questions,and it is import before the administrative public interest litigation.These questions include the status of damage,the rectification of the relevant units,and the standard to file a public interest litigation.In view of the procuratorial organ is a"player"and"the referee"double identity of embarrassment,and considering the determination of the claims in the public interest litigation,the determination of causality and there are many professional aspects need to be solved,so the introduction of the third party on behalf of assessment mechanism,positive with the help of a regular force,It has become an important measure to enhance the scientific,professional and objective nature of public interest litigation.
