摘要
"互联网+"的大背景下,货到付款是商家或平台致力于提供多样化支付方式的体现。然而,外卖领域频繁发生恶意到付,导致消费者和经营者权益双双受损,现行司法体制内却无外卖恶意到付的相关案例。鉴于受害方确存在维权困境,且外卖恶意到付实质上有违背民法基本原则、侵害他人隐私、破坏市场秩序之嫌,故从事前防范、事后规制两个角度入手,为商家、平台及被点餐人制定了科学的救济机制。
Under the background of "Internet +", cash on delivery is the embodiment of diversified payment methods that merchants or platforms are committed to providing. However, there are frequent instances of malicious payment in the take-out area, which results in the loss of both the rights and interests of consumers and operators. In the current judicial system, there are no cases of delivery malicious payment. In view of the fact that the aggrieved party is in a difficult position to defend its rights,it is suspected that the malicious delivery of take-out actually violates the basic principles of civil law,infringes on the privacy of others and destroys the market order. Therefore, from the perspective of preprevention and post-regulation, the paper develops a suitable relief mechanism for merchants, platforms and consumers.
