摘要
当前正值我国农村集体产权改革深化阶段,社区型合作社也迎来了新的发展局面。但关于社区型合作社何以在我国农村得以蓬勃发展?其本身还是否符合"合作社"本质性规定?现有文献缺少相应讨论。基于此,选取社区合作社协助村庄治理这一角度,分析其载体功能表达机制,并对其"同一性"进行检视以对上述问题进行回应。研究表明:社区型合作社的载体功能表达为"项目接包"与"目标动员"两个维度,并且具有正反双向制度绩效;其发展符合法理层面下的"间接同一性"本质性要求,但不符合"罗虚代尔原则"绝对意义下的"直接同一性"本质性要求。政策含义是:社区型合作社载体功能的表达是其得以发展的重要原因,应当充分抓住农村集体产权深化改革的契机,在与政府互动的过程中逐渐改善外部经营环境,通过载体功能带动其经济功能及其他功能的实现。
At present,rural collective property right system reform in China is at the deepening stage,and community cooperatives enter into a new development situation. But how can community cooperatives flourish in rural China? Does it still conform to the essence of "cooperative"? There is a lack of discussion in the existing literature. Based on this,this paper analyzes the function expression mechanism of community cooperatives from the perspective of assisting village governance,and examines their "identity "to respond to the above questions. The research show s that the carrier functions of community cooperatives are expressed in two dimensions of "project contracting"and "goal mobilization",and they have positive and negative institutional performance. Its development conforms to essential requirement of "indirect identity "under the legal principle,but not to the essential requirement of "direct identity"under the absolute meaning of "Rochdale"principle. The policy meaning of the paper is that the expression of the carrier function of community cooperatives is an important reason for their development. We should fully seize the opportunity of deepening reform of the rural property rights,gradually improve the external operating environment in the process of interacting with the government,and drive the realization of its economic and other functions through the carrier function.
