摘要
党的十九大明确提出“自治、法治、德治”三位一体的乡村治理框架。事实上,这个框架中“法治”与“德治”,及其关系问题一直广受关注。“相容说”认为二者具有对立统一关系,而要使“相容说”成立,使这个命题成为可理解的(intelligible),就要采取一种最佳说明进路,根据这个说明,在一些意义上,法治与德治是统一的;在另一些意义上,法治与德治是对立的。这些意义之间并非无法共存,而是相容的(compatible)。甚至只有从所有这些意义出发,才能获得对法治与德治关系更周延与深刻的理解。
The Nineteenth National Congress of the Communist Party of China(CPC)clearly sets forth the rural governance framework of"autonomy rule of law and rule of virtue".In fact,the relationship between"rule of law"and"rule of virtue"in this framework has been widely concerned.The"compatible theory"holds that they have a relationship of unity of opposites.In order to justify the"compatible theory"and make this proposition intelligible,people need to adopt a best explanation of it,and according to the explanation,the rule of law and the rule of virtue are unified in a sense;but in other cases,the rule of law and the rule of virtue are opposites.The two can coexist and are compatible.Even only from all these meanings can we get a more thorough and profound understanding of the relationship between the rule of law and the rule of virtue.
