摘要
目的:对济南市历城区2013-2018年医疗卫生行政处罚案件进行研究,查找问题,及时总结经验,推进医疗卫生执法工作更好的开展。方法:对该区2013-2018年查处的医疗卫生案件进行整理,形成Excel数据库,利用spss20.0进行统计分析。结果:该区医疗卫生案件以无证行医居多;无证行医案件和有证单位案件案源不同;无证行医案件违法主体以个人为主,有证单位案件违法主体以营利性医疗机构居多;办案广度和深度不够;无证行医案件办案总体耗时要长于有证单位案件;需催告和申请法院强制执行案件过多,工作量增大;执法程序以一般程序为主;罚款总额及案均罚款额度年度间变化不一。建议:采取多种方式,进一步加大医疗市场监管力度;充分利用卫生监督协管员,做好非法行医巡查工作,拓宽案件来源;拓展卫生行政执法广度和深度;合理运用简易程序和一般程序,提高行政效率和执法效果;把握好时间节点,做好处罚后工作。
Objective:To study the cases of health administrative punishment in Li Cheng District of Jinan City from 2013 to 2018,find out the problems,summarize experience in time,and promote the better development of medical and health law enforcement.Methods:The health cases investigated and dealt with in this area from 2013 to2018 were sorted out and Excel database was formed.Statistical analysis was carried out using SPSS 20.0.Results:Health cases in this area were mostly practicing without license.Cases of practicing without license and cases of certificated units had different sources.Cases of practicing without license were mainly illegally committed by individuals.And cases of licensed units were mainly illegally committed by profit-making medical institutions.The scope and depth of handling cases were insufficient;cases of practicing without license were generally longer than cases of licensed units;cases of practicing without license needed to be urged and applied for compulsory enforcement by courts.Too many pieces,the workload increased;law enforcement procedures were mainly based on general procedures;the total amount of fines and the average amount of fines varied from year to year.Suggestions:We should adopt various ways to further strengthen the supervision of the medical market;make full use of the health supervision co-administrators to do a good job of illegal medical inspection and broaden the source of cases;expand the breadth and depth of health administrative law enforcement;rationally use summary procedures and general procedures to improve administrative efficiency and law enforcement effect;and grasp the time node to do a good job after punishment.
