摘要
我国是农业大国,也是肥料生产和使用大国,但目前的监督管理模式为市场监督管理、农业农村等部门均共同监管,导致多头监管多头执法,存在监管漏洞,从而导致肥料市场监管执法不畅。为规范肥料市场秩序,促进农业发展,维护农民合法权益,要强化监管主体责任,建议国家制定并出台《肥料管理条例》,并完善配套法律法规,将肥料生产、经销及推广使用纳入法制轨道,使各个阶段的管理有法可依。
China is an agricultural country and a big country in the production and the use of chemical fertilizers.But the current supervision and management model is supervised management by both Market Supervision and Bureau of Agriculture and Rural Affairs,which lead to multi-supervision,duplicate law enforcement and regulatory loopholes,as a result,the supervision and enforcement of fertilizer market is not smooth.For standardizing the fertilizer market,promoting agricultural development,safeguarding the legal rights of peasants and strengthening the responsibility of supervision subjects,it is recommended that the State should formulate and introduce the regulations on fertilizer management,improve the supporting laws and regulations,and integrate fertilizer production,distribution and popularization into the legal track,which lead to the legal management of all stages.
