摘要
研究目的:探究乡村振兴视域下,工商资本流转土地经营权的法律规制。研究方法:规范分析法、文献研究法、历史研究法。研究结果:基于防控农地流转风险的法政策考量,《农村土地承包法》第45条对工商资本设定了“资格项目审查”和“管理费用收取”等多项法律规制。依法理视角检视,上述规制存在“审查范围过宽易于诱发违约”、“管理费用收取缺乏充足法理依据”等诸多不合理性。研究结论:为完善工商资本流转土地经营权的法律规制,首先应限缩审查范围、取消“管理费用收取”,同时通过完善农村集体经济组织法人制度、健全土地经营权市场退出机制等综合举措加以制度上的统筹规划,以期实现政策鼓励与法律规制的动态平衡。
The purpose of the study is to explore the legal regulation on industrial and commercial capital transferring land management rights from the perspective of rural vitalization.The research methods include normative analysis,literature research and historical research.The research results show that based on the legal policy considerations for preventing and controlling the risk of agricultural land transfer,Article 45 of the Rural Land Contract Law sets a number of legal regulations on industrial and commercial capital,such as“project qualification review”and“administrative fee collection”.From the legal perspective,the above-mentioned regulations have many irrationalities such as“the scope of review is too wide and thereby induces default”and“administrative fee collection lacks sufficient legal basis”.In conclusions,to improve the legal regulation on industrial and commercial capital transfer of land management rights,the scope of examination should be limited and the“administrative fee collection”should be cancelled.Moreover,the legal person system of rural collective economic organization and the market exit mechanism of land management rights should be improved to achieve a dynamic balance between policy incentive and legal regulation.
