摘要
劳动争议案件调解方式有多种,行政调解在其中居于重要地位,具有公信力强、调解水平高、省时省力的优点。文章在分享了深圳市××区劳动人事争议调解中心经验的基础上,针对劳动争议行政调解存在的诸多问题,从完善启动机制、扩大管辖范围、缩小受案类型、缩短结案期限、实行部分案件强制调解、补强调解效力等方面提出建议,从而完善我国劳动争议行政调解制度。
There are many ways of conciliation in labor dispute cases.Administrative conciliation plays an important role in terms of conciliating with the advantages of strong credibility,strengthening conciliation ability,and saving both time and effort.Based on experience of Shenzhen××district labor dispute mediation center,in consideration of the existing problems of labor dispute administrative conciliation,this paper puts forward suggestions on improving the startup mechanism,expanding the scope of jurisdiction,narrowing case range,shortening the settlement period,implementing some cases compulsory conciliation,emphasizing validity of conciliation,etc.Thus consummates our country administrative conciliation system of labor dispute.
