摘要
司法责任制是当下中国新一轮司法改革的核心概念。在理解和解释司法改革实践进程的意义上,司法承包责任制作为一种解释性的概念,能够为中国本轮司法改革的行动逻辑与治理风险提供一种分析框架。司法承包责任制的主要特征体现在其责任主体、考核方式和激励机制等,其治理风险与司法公信力、司法现代化、司法需求和司法队伍稳定等方面有着密切关联。
The judicial accountability system is a core concept of China's current judicial reform. In order to understand and interpret the process of judicial reform, we propose the notion of contracted judicial accountability system, hoping to offer a framework for analyzing the logic of action and the risks in governance involved in the current judicial reform. The contracted judicial accountability system is characterized by its clear definitions of who will take responsibility, how the performance is evaluated and what incentives are available. Its capacity of managing the risks in governance is determined by such factors as the judicial credibility, modernization, demand and the availability of a contingent of competent judicial professionals.
