摘要
行政强制措施在适用过程中存在违反法定程序,超范围、超时限滥用,用行政强制措施代替行政处罚等问题,严重侵犯公民人身、财产权益。然而相关行政强制措施监督体系不健全,难以实现有效监督。检察机关作为专门的法律监督机关,对涉及公民人身、财产权益的行政强制措施进行监督具有天然优势。当前,对涉及公民人身、财产权益行政强制措施进行检察监督不仅缺少明确的法律依据和具体的制度设计,而且在理论上也没有取得共识。实现对涉及公民人身、财产权益强制措施的有效监督,应在加强以法律监督权为基本属性的检察权设置的基础上,进一步明确我国行政强制措施检察监督理念,对侵犯公民合法权益型行政强制措施的检察监督予以制度化设计,如建立健全检察监督的法律规范体系,明确检察监督的范围,构造多元化的检察监督手段,设置富有实效的检察监督程序等。
The administrative coercive measures which are in violation of legal procedures,out of range,abusing over time,taking the administrative coercion measures instead of administrative sanctions,infringe civil rights and property interests. However,the supervision system of administrative coercive measures can’t implement effective supervision. The procuratorate has advantages to take the supervision over administrative coercive measures involving civil rights and property interests. In lack of specific legal basis and institutional design,the administrative coercive measures are confronted with restrictions. On the basis of defining the concept of supervising,there are four aspects that should pay more attention to establish the hierarchical supervision mechanism. In general,it is ought to improve the legal system,the scope,the means and procedure of supervision to make the supervision efficient.
