摘要
我国传统社会的司法活动,不仅仅有国家的司法活动,同时还存在着与之并存的家族性司法活动。山东曲阜孔府的司法由于种种原因成为中国传统社会家族性司法的典型。本文从孔府司法的依据、孔府司法的主体与客体、孔府司法的运行机制等方面论述孔府的具体司法活动,认为孔府司法是当时国家司法的有效补充,但它也影响了国家地方司法权的整体局面。
In the Chinese traditional society,there are not only state judicial activities,but also co-existing family judicial activities.Confucian Residence, located in Qufu of Shandong Province,became family judicature quintessence in Chinese traditional society for its particular in judicature.This paper elaborates Confucian Residence's concrete judicial activities by the Confucian Residence judicial gist,main body and object,and its judicial operation mechanism,pointing out that the judiciary was an effective national judicial supplement,but also simultaneously affected the national local judicial power of the overall situation.
