摘要
公安交通管理行政强制措施是实现道路交通管理必不可少且使用最为频繁的行政执法手段。其在立法上存在设定权不严格和内容规定不严谨的法律问题;在实施过程中面临缺乏统一辨识标准、实践性不强、交通警察法律素养不足以及监督机制不健全导致其实施不到位等实务问题。解决对策是:统一辨识标准,在调研基础上明确公安交通行政管理强制措施的种类;从法律层面规范公安交通管理行政强制措施的设定、创新并规范实施主体的规定;通过开展教育培训、实务训练、加强执法监督、明确法律救济。
Administrative coercive measures are the most essential and the most frequently-used means in public secu. rity traffic management. However, there are some problems in the legislation and in the law enforcement practice leading to poor implementation effect, including inexact enacting right, loose content rules, disunified identification standard, weak practicalness, inadequate legal literacy of traffic police and imperfect supervision system. The following countermeasures are suggested. First, identification standard should be unified and the types of administration coercive measures should be clari. fied based on investigation. Second, the establishment of administrative coercive measures should be regulated from the le. gal level and the provisions of the executor should be innovated and standardized. Third, the supervision system should be strengthened and legal relief should be defined through carrying out education and training, practical training.
