摘要
“责令停止生产”作为环境行政执法中常见具体行政行为之一,学界对“责令停止生产”的法律属性存在行政处罚说、行政强制措施说、行政命令说等不同观点,环境行政执法以及司法审判实务对该行为亦存在定性不明的情形。经实证研究发现,“责令停止生产”既可能针对违法行为,也可能涉及合法生产。故需要进一步明确“责令停止生产”的法律属性认定——应当在不同执法语境下分析其法律属性。若责令停止生产仅涉及对违法行为的纠正,其法律属性应属于行政命令;若停止生产涉及合法生产部分的禁止,其法律属性应认定为行政处罚。
"Order to stop production"is one of the common administrative actions in environmental administrative law enforcement.Scholars have different views on the legal attributes of the administrative act of“ordering to stop production”,such as administrative punishment theory,administrative enforcement measures theory,administrative orders theory,etc.Environmental administrative law enforcement and judicial trial practice are also unclear about the legal nature of this administrative act.Empirical research found that"order to stop production"may not only be aimed at illegal activities,but also involve legal production.Therefore,it is necessary to further clarify the legal attribute identification of“ordering to stop production”,it should be analyzed in different situations.If the administrative act only involves the correction of the illegal act,its legal attribute shall belong to the administrative order.If the prohibition of production involves the legal production part,its legal attribute shall be recognized as administrative punishment.
