摘要
投标保证金是项目投标过程中的一个重要元素。本文从法律源头出发,明确了投标保证金的含义和作用,结合实践案例展示了投标保证金支付要求,总结了常见的因投标保证金导致投标被否决的几种情况,基于投标人视角着重论述了办理投标保证金的要点、不予退还的情形及其回收管理。本文对于招投标从业人员具有较强的实践指导价值。
Bid bond is an important element in the process of project bidding. Starting from the law, this paper clarifies the meaning and function of bid bond, and demonstrates the submission requirements of bid bond combined with practical cases, and summarizes several common cases of rejection of bid due to bid bond. Based on the bidder’s perspective, this paper emphatically discusses the key points of submitting bid bond, non-refundable situations and taking-back management. This paper has a strong practical guidance value for bidding practitioners.
