摘要
"河长制"作为当下重要的水污染防治机制,行政措施与法律制度的张力关系贯穿于"河长治污"的始终。依赖行政措施推动治水的"河长制"确实使水质得到实质性改善,但有限的责任承包、容易衍生反邻避行为等局限性使得"河长制"政策成效的持续提升受到影响。两类治水工具不存在孰是孰非的问题,关键在于二者的融合与细化,具体可从构建立体式法规体系、推动水资源管理机构改革、依靠"制度治水"等方面推动"河长制"的持续改进。
"He Zhang(the river-administrator) System"is considered as an important mechanism for water pollution control, and the interactive relationship between administrative measures and legal system runs through the whole process of "He Zhang(the river-administrator) controlling the pollution"."He Zhang(the river-administrator) System", which relies on administrative measures to promote water control, has indeed led to substantial improvement in water quality, however, limitations such as limited liability and derivative anti-nimby behavior also affect the continuous improvement of the policy effect of it. The key lies in the integration and refinement of the two kinds of water treatment tools. Specifically, we can promote the continuous improvement of "He Zhang(the river-administrator) System"from the aspects of constructing a three-dimensional legal system, promoting the reform of water resources management organization, and relying on the system to control water.
