摘要
开展"一带一路"沿线的国际科技合作交流,不仅要促进沿线各国在经济技术上的互惠共通,更要在制度建设上为"一带一路"提供中国方案。以立法体系、行政执法体系、司法体系、法律服务体系为内容的法律保障体系是"一带一路"国际科技合作健康发展的重要支撑。在考察和评价陕西开展"一带一路"国际科技合作法制保障体系实践基础上,从创新立法格局、加强行政执法、深化司法改革、提升法律服务等方面提出优化陕西开展"一带一路"国际科技合作法律保障体系的对策建议,协力推动沿线国家人类命运共同体建设。
To carry out international scientific and technological cooperation and exchanges along the routes of the Belt and Road,we should not only promote mutual economic and technological mutual benefit among countries, but also provide China’s plan for the Belt and Road in terms of institutional construction. The legal guarantee system, administrative law enforcement system, judicial system and legal service system, are an important support for the healthy development of the Belt and Road cooperation. On the basis of investigating and evaluating the practice of the Belt and Road international scientific and technological cooperation legal system in Shaanxi,this paper puts forward suggestions on optimizing the legal security system of the Belt and Road international scientific and technological cooperation in Shaanxi province from such aspects as innovating legislation pattern, strengthening administrative law enforcement, deepening judicial reform and improving legal services, in order to promote the human destiny of countries along the community building.
