摘要
在建工程抵押权与工程价款优先受偿权恩怨已久,纷争不断。由于公平处理的立法目的、债权受偿的多层次格局等破产程序的特殊性,导致二者在破产程序中的冲突更为激烈。管理人可以根据破产法规则及破产案件实际情况对两种权利的行使进行微调整,比如对在建工程抵押权与工程价款优先受偿权受偿范围进行可能的区分,以平衡二者的收益和损失,但根本上仍需要工程价款优先受偿权理论和立法在基本面上的统一,这样才能真正预防并有效解决二者之间的纠纷,形成对各方均相对公平的局面。
The mortgage right of the construction project and the priority compensation right of the project cost have been enmity for a long time. Due to the particularity of bankruptcy proceedings such as the legislative purpose of fair treatment and the pattern of differential compensation of creditor’s rights, the conflict between them is intense. The bankruptcy trustee can make minor adjustments to the exercise of the two rights according to the bankruptcy law rules and the actual situation of bankruptcy cases. For example, the scope of the mortgage right of the construction and the priority compensation right of the project cost may be distinguished to balance the gains and losses of the two rights. However, it is still necessary to unify the theory of priority compensation of project cost and legislation on the basic level, so as to prevent and effectively solve the disputes between the two and form a relatively fair situation for all parties.
