摘要
我们应当从监督或追究的主体、对象、内容(事由)和方式等方面辨析与诠释司法机关追究政府生态责任的职能定位。在中国特色的政府生态责任追究体系建设中,司法机关具有不可替代的独特地位和多重层面的独到价值。目前我国司法机关监督和追究政府生态责任面临观念、制度和能力等多方现实难题,其主要原因在于生态环境司法技能的更高要求、生态环境司法权力的不当受限和生态公民社会发育的相对不足。优化司法机关追究政府生态责任职能应坚持中国特色、司法独立、司法能动、最后防线、合作追责、生态优先原则,要以完善教育强化监督与追究政府生态责任的司法观念,以深化改革创新监督与追究政府生态责任的司法制度,以健全保障提升监督与追究政府生态责任的司法能力。
When investigating the government s ecological responsibility,we should interpret the function of judiciary authorities from the viewpoints of subject,object,content(cause)and mode of supervision or investigation.At present,judiciary authorities inChina face many challenges in that eco-environment calls for a higher degree of judicial skills,the eco-environmental judicial power is unreasonably restricted and an eco-civil environment has not been fully developed.Our effort should center on judicial independence,judicial activism,the last line of defense,cooperation liability,and the principle of ecological priority.We should also heighten the judicial awareness,reform judicial system and improve judicial skills so as to effectively investigate the ecological responsibility of government.
