摘要
家事诉讼作为一种特殊类型的民事诉讼,其不仅涉及到当事人之间的私人利益,更涉及到基于家庭秩序而产生的公共利益以及社会的公序良俗。为此,大陆法系的许多国家(地区)针对家事诉讼设立了许多独具特色的制度,检察机关参与家事诉讼制度便是其中之一。对于我国而言,在当前涉及公益的家事诉讼案件日益繁多、复杂的背景之下,考察并构建适合我国的检察机关参与家事诉讼制度亦有其有其正当性和必要性。
As a special type of civil litigation, family litigation involves not only the private interests of the parties, but also the public interests based on the family order, as well as the public order and customs of the society. For this reason, many countries (regions) in the civil law system have set up many unique systems for the family litigation, one of which is the participation of the procuratorial organs in the family litigation system. Under the background of the increasing variety and complexity of the current family litigation cases involving the public welfare, it is also legitimate and necessary to investigate and construct the system of participation of the procuratorial organs in the family litigation system which is suitable for the People's Republic of China.
