摘要
医疗机构中药制剂作为中医药传统知识的重要载体,是实现中医药知识和技术传承的推动力,也是中药创新的重要来源,因此有必要确立系统的知识产权保护体系。当前我国中医药知识产权体系主要以专利制度为核心,由于医疗机构中药制剂的特殊性,医疗机构往往存在专利申请意愿较低,难以达到三性标准等问题,在这种背景下,商业秘密保护为制剂的保护提供了较好的途径。医疗机构中药制剂的保护必须遵循其自身的发展规律,医疗机构应当以专利制度为基础,充分利用专利信息资源,挖掘专利技术,同时有效协调和衔接专利和商业秘密保护,构建双重保护机制,促进医疗机构中药制剂的发展。
As an essential carrier of traditional Chinese medicine knowledge, traditional Chinese medicine hospital’s preparations are the driving force behind the development of the Chinese medicine knowledge and technology inheritance, and also an important source of Chinese medicine innovation. Therefore, it is necessary to establish a systematic intellectual property protection system. At present, the patent system is an essential part of the intellectual property system of Chinese medicine. Due to the special characteristic of hospital traditional Chinese medicine preparations, some problems can be seen in protecting them, such as low willingness to apply for patents, difficulties to achieve the three standards and so on. In this context, trade secret protection provides a better choice. The protection of hospital traditional Chinese medicine preparations must follow its own development rules. Medical institutions should make full use of patent information resources and explore patent technology based on patent system. What’s more, a dual protection mechanism, which links the patent and trade secret, should be established to promote the hospital traditional Chinese medicine preparations.
