摘要
环评审批行为对环评通过和项目实施至关重要,也直接影响着环评制度的实效和功能发挥。囿于科学不确定性和科技专业性,环评审批因其自由裁量权的扩张而衍生了诸多问题。基于司法自制基础的环评审批司法审查旨在对这一问题进行回应,但亦面临着一系列难题。通过对五十份裁判文书的样本分析发现,法院在审查原告主体资格时过于严格,对环评审批的程序问题局限于形式审查,对环评审批所涉的实质问题审查通常选择退让等。环评审批司法审查的重构应当厘定司法审查的原告主体资格;建立环评及审批全流程的链式程序审查模式,以程序理性的确立保障司法审查的实效;变革适用司法的合法性、合理性、充分性实质审查方式,以专家辅助人的引入发挥司法审查的监督功能。
The approval of Environmental Impact Assessment decides the outcome of EIA process and implementation of relevant projects,even directly affects the effectiveness and function of EIA system.A number of problems caused by the expansion of administrative discretion on EIA approval appeared with the scientific uncertainty and technical expertise.Judicial review of EIA approval based on the judicial self-control is designed to respond to such an issue,but it also faces a series of problems.Through analyzing 50 selected judgment documents,it is found the following practical problems but not limit to,too strict review of plaintiff's subject qualifications,limited formal review of EIA approval procedure and conscious ignorance of substantive review.Therefore,the reconstruction of the judicial review of EIA approval should focus on determining the appropriate plaintiff,establishing a chain-based procedure review mode for the whole process of EIA and its approval to ensure effectiveness of judicial review with the establishment of procedural rationality and transforming methods of legality,rationality and adequacy review to make the supervision function efficient especially with the introduction of expert assistants.
