摘要
自2017年1月网络司法拍卖制度在全国法院推行以来,取得成绩的同时,也存在一些问题:效果差强人意、法院劳而少功、操作引发争议、风险难以防范。制约网拍制度发展的因素包括:法律规范有待完善、统计报表设计不合理、规则革新遭受外部阻力、内外协调配合机制亟待优化。为此,亟需从立法指引、顶层设计、规则创新、分工协作等方面予以改进。
Since the implementation of the online judicial auction system in the national courts in January 2017, there have been some achievements, but there are also some problems: ineffectiveness in result, low efficiency in the courts, disputes in operation and high risks. The factors restricting the development of the racquet system include: the legal norms need to be improved, the design of statistical reports is unreasonable, the rule innovation suffers from external resistance, and the internal and external coordination mechanism needs to be optimized urgently. Therefore, it is urgent to improve the legislative guidance, top-level design, rule innovation, division of labor and cooperation.
