摘要
洞庭湖湿地是中国最大的一块淡水湿地,也是国际重要湿地之一。但由于自然与人为原因的相互作用,洞庭湖湿地面临着湖面和湖容缩小、湿地生态功能衰退、生物多样性减少等危机,完善洞庭湖湿地的保护已成为我国立法任务的重中之重。《湖南省湿地保护条例》是洞庭湖湿地保护的立法基础,但存在着缺乏整体性考虑、洞庭湖湿地保护立法体系不健全、监管与执法体制不合理等缺陷,不足以针对洞庭湖湿地进行整体有效的保护。因此,急需对洞庭湖进行专门立法,制定一部《洞庭湖保护条例》,并设置“湿地保护”专章,通过建立洞庭湖湿地综合监督管理与执法体制等途径来切实保护洞庭湖湿地,最终实现人与自然的和谐发展。
Dongting Lake Wetland is China’s largest freshwater wetland and one of the most important wetlands in the world. However,due to the interaction between nature and human factors,the Dongting Lake wetland faces the crisis of shrinking lake surface and lake capacity,the decline of wetland ecological function,and the reduction of biodiversity.Improving the protection of Dongting Lake wetland has become the top priority of China’s legislative tasks.The Hunan Province Wetland Protection Regulations are the legislative basis for the protection of Dongting Lake wetland, but there are defects such as lack of overall consideration,imperfect Dongdong Lake wetland protection legislative system, unreasonable supervision and law enforcement system,etc.,which is not enough for the overall Dongting Lake wetland.Effective protection.Therefore,it is urgent to carry out special legislation on Dongting Lake,formulate a “Dongting Lake Protection Regulations”,and set up a “wetland protection” special chapter to protect the Dongting Lake wetland through the establishment of the Dongting Lake wetland comprehensive supervision and management and law enforcement system.Realize the harmonious development between man and nature.
