摘要
档案开放是综合档案馆必须履行的义务,优化完善开放鉴定程序是我国档案开放面临的现实要求。文章采用文本分析法和问卷调查法,对我国档案开放鉴定程序的法定依据和现行执行方式进行了调查和归纳梳理,发现目前档案开放鉴定的问题主要表现在解密与划控程序关系不清、“三审”框架下职责分配不清、主体协作机制有待完善三个方面,并以档案开放义务和档案不开放权利分析为核心,提出了一个档案开放鉴定的程序框架,并对其中的职责关系和协作机制进行了讨论,最终认为档案馆应在开放鉴定中更多地承担仲裁者角色。
Disclosure of archives is an imperative obligation for general archives and optimizing the procedure of disclosure appraisal is practically required in China. This paper adopts qualitative methods as text analysis on policies and questionnaire to conclude on the legal basis and practical modes of execution of archive disclosure procedure. It finds out that the issues lie in three aspects, namely the ambiguous relationship between decoding and disclosure as procedures, unclear responsibility assignment under the framework of “Triditing System”, and the coordination mechanism await to be improved. It finally proposes a procedural framework for archive disclosure appraisal centered with the analysis between the obligation of disclosure and the right of closure, and further discusses on the responsibility relationships and coordination mechanism within;and holds that public archives should act more as intercessor in disclosure appraisal.
