摘要
新时代社会主义法治观和发展观,是中国知识产权制度建设的重要理论基石和思想引领。法治观回答和解决知识产权立法、执法、司法和守法的基本问题,提出了知识产权法治建设的基本命题,即指导思想、基本目标、运行方式及效果形式;发展观作用于知识产权创造、运用、管理、保护、服务等方面的全部过程和环节,其核心要义是知识产权事业发展总体思路、知识产权政策的科学维度和法治基础、知识产权运作要素的绩效要求。法治观和发展观的思想引领途径,或是通过立法程序表现为法律(如知识产权立法宗旨表达、知识产权法典化安排、知识产权法律现代化改造以及知识产权替代性制度选择),或是通过政府创制活动制定为政策(如谋划国家知识产权战略、制定知识产权事业规划、完善以知识产权为导向的公共政策体系),从而完成从思想理念到制度构成的转换。
The socialist concept of rule of law and development outlook in this new era is an important theoretical cornerstone and ideological guide for the construction of China’s IP system. The rule of law concept answers and solves the basic problems concerning IP legislation, law enforcement, judicature and law-abiding, putting forward the basic proposition for constructing rule of law for IPR, namely the guiding ideology, basic objectives, way of operation and the relevant e ffects. The development outlook acts on the whole process of IP creation, application, management, protection and service;its core essence includes the overall thinking on the IP development, the scienti fic dimension and the rule of law basis for IP policy, and the performance requirements for IP operation. There are two ways to realize the concept of rule of law and development outlook for IP, namely, the legislation through legal procedures, for example, expression of the legislative purpose, codi fication of IPR, modern reform and upgrading of IP law, and choice of alternative systems to IP;or policy-making by government, for example, national IP strategy planning, planning IP undertakings, and perfecting the IP-oriented public policy system. Thus the transformation from ideology to system structure is completed.
