摘要
改革开放四十年来,我国海洋环境保护法治建设经历了艰难摸索的起步阶段、顺应时代的完善阶段以及力求创新的深化阶段,取得了长足的进步与巨大的成就。但随着社会的不断发展,海洋环境保护法在实施过程中也出现了各种状况,遭遇了众多实践困境,这也促使我国的海洋环境保护法治紧随时代步伐不断发展完善。本文通过对我国海洋环境保护法实施现状及实践困境的管窥,结合我国海洋环境遭遇的实际威胁和污染破坏,在问题导向意识下透视我国海洋环境保护法的未来走向,提出制定积极有效的配套措施,进一步完善我国海洋环境保护法,更好地促进我国的海洋生态治理与环境保护。
Since 40 years of reform and opening up, China's legal construction of marine environmental protection has undergone such three phases as beginning, improvement and innovation to have made considerable progress and great achievements. However, various situations have also appeared in the implementation process of marine environmental protection law with the continuous development of society, making us encounter many practical difficulties, so that it is necessary for us to develop and improve our country’s marine environmental protection law with the pace of the times. Based on the current situation and practical dilemma of China’s marine environmental protection law and combined with the actual threat and pollution damage to China’s marine environment, this paper not merely deals with the future trend of China’s marine environmental protection law under the problem-oriented consciousness, but also puts forward the formulation of positive and effective supporting measures to further improve China’s marine environmental protection so as to better promote our country’s marine ecological governance and environmental protection.
