摘要
在现代社会,随着两性平等的日益推进,家庭不和谐以及性别不平等问题日益凸显。法律面前人人平等当然包括两性平等,但法律往往通过赋予女性某种权利来追求两性平等,这种做法无法改变社会中的根本性支配结构。只有充分认识到“公私二分法”的根源和弊端,并把关怀和尊重维度下的正义引入家庭,才有助于两性平等的真正实现。
In the contemporary world, family disharmony and sexual inequality become obvious with the promotion of sexual equality. The principle that everybody is equal before the law consists of sexual equality, but law itself always seeks for sexual equality by conferring some right on women, which cannot change the radical dominative structure in the society. Only by fully realizing the root and drawbacks of ‘separation of public sector and private sector’ and inserting justice based on care and respect into families can sexual equality be truly realized.
