摘要
全球海洋生态环境治理是全球治理的重要组成部分,环境治理从主体上看存在不同层级、多元交叉的治理架构,并构成了从全球层到基层社区层的多层级治理体系。多层级治理体系具有决策模式的多样化,需要治理主体的集体行动,并关注治理政策的开放性。近年来,全球海洋生态环境治理中联合国中心地位受到挑战,治理区域化以及海洋治理合作不足,导致海洋生态环境治理呈现形式上的多层级、实质上的碎片化状态。从当前全球海洋生态环境的区域治理、重大突发环境事件和国内环境基层治理等视角考察,全球海洋生态环境治理需要体现整体性治理理念,关注国家责任和区域海洋治理的现实性,重新审视联合国为中心的海洋治理规则重构,促使以政府“元治理”为核心,运用科技手段、结合基层“微治理”等创新模式的多层级海洋生态环境治理机制的进一步完善。
Global marine eco-environment governance plays a vital role of global governance.From the current governance subject,the environmental governance has different levels of governance structures),and constitutes a multi-level governance system from the global level to the grassroots community level.The multi-level governance system has a variety of decision-making models,needs the collective action of the governance subject,and pays attention to the openness of the governance policy.The role of the UN as a center in the global marine eco-environment governance has been challenged.The regionalization of governance and the lack of cooperation in ocean governance have led to the situation of multi-level governance in form and fragment in actual.From the perspective of regional governance of current global marine eco-environment,major environmental emergencies and domestic environmental grassroots governance,the global marine ecological environment governance needs to reflect the overall governance concept,pay attention to the reality of national responsibility and regional ocean governance,re-examine the reorganization of the United Nations-centered ocean governance rules,and promote the use of government"meta-governance"as the core,using scientific and technological means,combining with innovative models such as"micro-governance"at the grassroots level to improve the multi-level marine eco-environment governance mechanism in further.
