摘要
在日益加深的社会老龄化、劳动年龄人口逐年下降等社会背景下,高龄农民工的数量逐年递增,这其中不乏达到法定退休年龄的超龄农民工,这些本该颐养天年的老人迫于未富先老的现实生活压力,不得不继续工作,由于相关立法不完善,企业安全生产责任落实不全面、超龄农民工自身维权意识较为淡薄等因素影响,对于没有养老保险、医疗保障,也没有可依靠组织的处于城市边缘的超龄农民工群体来说,其因公受伤时的工伤权益无法获得实质性保护,因此需要予以研究探讨。
Under the background of the deepening social aging and the declining population of working age, the number of elderly migrant workers is increasing year by year. Among them, there are many over-aged migrant workers who have reached the legal retirement age. These old people who are supposed to take care of themselves are forced to continue working under the pressure of the real life before they get rich. Due to the imperfection of relevant legislation, they have reached the legal retirement age. due to the incomplete implementation of the responsibility for safety in production of enterprises and the weak awareness of safeguarding the rights of over-aged migrant workers themselves, the rights and interests of over-aged migrant workers who have no endowment insurance, medical security and no dependable organizations on the edge of cities can not be obtained when they are injured on duty. Substantive protection is required.
