摘要
虽然我国司法界借助从属性判定劳动关系,但是司法界对从属性的定义与类型归类却存在不同理解,存在劳动关系泛化的风险,用工形式的灵活化则使问题更加突出。在劳动关系不断扩展的背景下,应当正确认识人格从属性与经济从属性间的差别,以真正实现劳资均衡。在确立人格从属性核心地位时,通过经济从属性完成对"准劳动者"的保护,建立权利义务均衡的"是否"与"强弱"相结合的从属性判断模式。
Although it makes the judgment about labor relationship in terms of subordinate attributes,the judicial circle of China differ in their opinions concerning the definition and categorization of subordinate attributes.There exist risks of generalization of labor relationship,and the flexibility of the employment form makes the problem more obvious.In view of labor relationship being extended constantly,we should understand the difference between personality subordination and economic subordination correctly to achieve the balance between labor and capital.To establish the core position of personal subordination,we need to protect the"worker-to-be"through economic subordination,and build a subordinate judging mode that considers"yes or no","strong or weak"and balances rights with duties.
