摘要
法治化是城市基层治理的核心内容、目标任务和路径保障。行法治不仅是党和国家的战略部署与规划,是国家治理现代化的重心和基础,更是城市基层治理走向善治的内生性需求。当下,城市基层治理还未完全脱离传统的"政党-政府"单中心权力控制阶段,国家权力既是治理秩序和治理有效性的保障,也存在挤压基层社会发育空间、偏离善治的风险和潜在的负效应等弊端,因而更加需要法的规范和引导。基层治理的法治化正循着一条顶层推动、基层实践和科技逼迫的路径。现阶段,推进城市基层法治化可化为公众参与和纠纷解决两个维度和着力点。公众充分有效的参与构成基层社会治理法治化的逻辑前提;矛盾纠纷的解决是基层治理的法治保障。两者是整个城市基层治理的过程轴中的重要环节且发挥着关键效用。这其中,程序和现代科技是促成和支撑治理法治化的重要方法与技术手段。
Rule of law is the core content, goal and path guarantee of urban grassroots governance. The rule of law is not only the strategic deployment and planning of the party and the state, but also the focus and foundation of the modernization of state governance. It is also the endogenous demand for urban governance at the grassroots level. At present, urban grassroots governance has not completely separated from the traditional "party-government" single-center power control stage. State power is not only the guarantee of governance order and governance effectiveness, but also the risk of squeezing grassroots social development space, deviating from good governance and potential negative. The effect is therefore more in need of norm and guidance of the law. The rule of law in grassroots governance is following a path of top-level promotion, grassroots practice and technology persecution. At this stage, the promotion of urban grassroots rule of law can be turned into two dimensions and focus points for public participation and dispute resolution. The full and effective participation of the public constitutes the logical premise of the rule of law in grassroots social governance;the resolution of contradictions and disputes is the rule of law guarantee of grassroots governance. Both are important links in the process axis of the entire city’s grassroots governance and play a key role. Among them, procedures and modern science and technology are important methods and technical means to promote and support the rule of law.
