摘要
黑社会犯罪是世界公害,世界各国、各地区对黑社会犯罪组织打击措施虽有不同,但是在共同严厉打击的立场上是一致的,我国《刑法》第294条规定黑社会性质组织应当同时具备组织特征、经济特征、行为特征和非法控制特征,其中非法控制特征是另外三个特征的集中表现和抽象形成,是犯罪组织发展到一定阶段后才具备的能力,故成为区别于其他犯罪组织的核心所在,在严厉打击的背景下,黑社会性质组织特征出现了新的变化,在司法实践中应当紧紧抓住非法控制特征中控制力、重大影响两个要素,准确判断非法控制的多种表现形式加以认定。
Mafia crime is a public hazard in the world.Although there are different measures against Mafia criminal organizations in different countries and regions of the world,they share the same position in striking together.Article 294 of The Criminal Law of China stipulates that mafia-like organizations should have organizational,economic,behavioral and illegal control characteristics at the same time.Among them,illegal control features are the other three.The concentrated expression and abstract formation of these characteristics are the abilities of criminal organizations after they have developed to a certain stage,so they have become the core of different criminal organizations.Under the background of severe crackdown,new changes have taken place in the characteristics of underworld-like organizations.In judicial practice,we should firmly grasp the two elements of control and significant influence in the characteristics of illegal control and accurately judge the right and wrong.The various forms of legal control should be identified.
