摘要
由立法者原意可知,确认无效诉讼在起诉期限规则上,存在初始且有意识的法律漏洞,需要法官进行填补。目前,除适用和不适用起诉期限条款两种做法外,最高人民法院在郭家新案中还创设了"适当期间"的漏洞填补方式。从权利保护必要性理论出发,"适当期间"实质是将确认无效诉讼起诉期限问题的判断权交给了法院,由法官进行裁量。为防范法官滥用裁量权,必须对其进行限制。一方面,在具体判断时需结合法律澄清的可能以及法安定和社会秩序的稳定等进行综合考量;另一方面,遵循个案性的判断准则和"适当期间"不低于法定起诉期限的标准。即便如此,根据《立法法》中法律保留条款的规定,确认无效诉讼的起诉期限规则最终应由法律作出规定,方为适当。
Known by the legislator’s original intention,on the time limit for prosecution, there are initial and conscious legal loopholes in affirmation invalid lawsuit, which need judges to fill. Currently, in addition to the two practices that apply and do not apply the terms of the prosecution period, in the Guo Jiaxin case, the Supreme People’s Court also created the type of loophole filling method of "appropriate period". Starting from the theory of the necessity of rights protection,"appropriate period" actually gives the court the power to judge the time limit for prosecution of affirmation invalid lawsuit, which is discretion by the judges. To prevent judges from abusing discretion, It is necessary to limit the exercise of their judgment. On the one hand, in the specific judgment, comprehensive considerations should be made based on the possibility of legal clarification and the stability of law and stability and social order. On the other hand, judges must also follow the criteria for individual judgment and the criteria for "appropriate period" not lower than the statutory time limit for prosecution. Even so, according to the provisions of the law retention provisions of Legislative Act, it is appropriate to confirm that the rules of the time limit for prosecution of affirmation invalid lawsuit should eventually be made by law.
