摘要
《洗冤集录》是由南宋宋慈于公元1247年所作的一部法医学著作,作为世界最早的、公认的系统法医学著作,它不仅记载了古代法医学相关经验知识,还记述了宋朝刑事司法检验中多种检验方法和规定,最为重要的是,其中所展现的诸如“慎刑恤狱”“事实为本”“证据至上”等法律思想,不仅在古代具有突破性意义,其对现代的法治建设也具有重要的借鉴作用。本文以卷一内容为重点,从对检验官员的法律规定入手,结合录中的真实案例,探究《洗冤集录》中所表达的法律思想和内涵,并对比现代法治进行辨析。
Collected Cases of Injustice Rectified is a work of forensic medicine written by Song Ci of the Southern Song dynasty in AD 1247.As the world’s earliest forensic,accepted and systematic literature,it records the ancient forensic medicine experience knowledge,but also describes the criminal judicial inspection in Song dynasty,and a variety of test methods and regulations.What’s more, Collected Cases of Injustice Rectified shows such legal thoughtas “Cautious penalty”,“Facts are the foundation”,“Evidence is the highest” and so on.The legal thoughts expressed above,which made a significant breakthrough in ancient times,provide a rich reference for the modern rule of law.Focusing on the content of volume one,this paper starts with the legal provisions of inspection officials,combines the real cases in the book,explores the legal thoughts and connotation expressed in the Collected Cases of Injustice Rectified ,and makes a comparative analysis of modern rule of law.
