摘要
一直以来,美国司法机关被认为是公正而神圣的,法院和法官被推上神坛,而事实却并非如此。美国现实主义法学的代表人物弗兰克在其著作《初审法院——美国司法中的神话与现实》中,从事实的不确定性、法官的个人性、法律的不确定性等方面展示了真实的美国司法运行过程,并通过建立法院判决的格式塔规则,确定和完善法官的自由裁量权以及建立和完善法律职业共同体等方法来重新确立起司法权威,再塑司法神话。
American judiciary has always been regarded as a symbol of justice, courts and judges play an essential and indispensable part in the country. However, Frank, the representative figure of American legal realism, in his book Courts on Trial: Myth and Reality in American Judicature , expressed real process of the United States judiciary. In his book, facts and legal uncertainty even judges personality can make a great difference for the cases result. In addition, through the judicial decision, American judiciary can develope the discretion and legal profession community, which can help to build judicial authority and reshape the judicial myth.
