摘要
文中分析了海事行政检查的行政事实行为本质,介绍了海事行政检查的特点,从队伍性质、保障船舶适航、检查深度等方面明确了海事行政检查的基本定位,在此基础上分析了海事行政检查的类别与基本内容,提出了规避执法风险的几点建议。
The paper studies the nature of maritime administrative inspection as a kind of administrative factual act, introduces the characteristics of maritime administrative inspection, and defines the basic orientation of maritime administrative inspection from the aspects of the nature of the team, the guarantee of ships’ seaworthiness, and the depth of inspection. On the above basis, it analyzes the categories and basic contents of maritime administrative inspection and puts forward suggestions on avoiding law enforcement risks.
