摘要
农民集体所有权的规范目的是实现农民集体成员权,经由民主决策程序实现村民自治。农民集体成员权是农民对集体所享有权利的总称,其行使的重要价值目标之一是实现对集体财产的分配正义。农民集体决议行为是农民集体成员权的主要行使方式和村民自治的民法体现,其法理基础在于根据程序正义的要求基于民主多数决的意思表示形成机制实现农民集体的公共选择。本文提出乡村治理体系“一体两翼”的理论:以乡村治理体系为“一体”,以农民集体成员权和农民集体决议行为为“两翼”;其中,健全乡村治理体系和完善农民集体决议行为规则的根本目的是保障农民集体成员权的实现。应妥当界定农民集体决议行为的成立和效力,区分农民集体决议行为的不成立与农民集体对外合同行为的法律效力,并在民法典物权编对农民集体决议行为的规定做相应完善。
The purpose of standardizing the peasant collective ownership is to achieve the peasant collective membership right and realize the self-governance of villagers through the democratic decision-making process.The peasant collective membership right is the general term of peasants'rights to the collectivity.One of the important value targets for its exercise is the realization of distributive justice of the collective property.The act of peasant collective resolution is the main way of exercising the peasant collective membership right and is also the reflection of self-government by villagers in the Civil Law.Its legal basis is the realization of public choice of the peasant collectivity based on the will declaration formation mechanism of democratic majority voting according to the requirements of procedural justice.This paper puts forward the theoretical model of"one body,two wings"on rural governance system,with the rural governance system as"one body"and the peasant collective membership right and the act of peasant collective resolution as"two wings".The fundamental purpose of perfecting the rural governance system and improving the rule of peasant collective resolution is to guarantee the realization of peasant collective membership rights.We should properly define the establishment and effectiveness of the peasant collective resolution,distinguish between the invalid of peasant collective resolution and the effectiveness of peasants'collective external contract,and improve the stipulation of peasant collective resolution in the compilation of property right in the Civil Code.
