摘要
随着人们对土地的稀缺性及资产性认知的加深,农村妇女土地权益纠纷数量呈不断上升之趋势,通过对现行保障农村妇女土地权益的法律和政策进行盘点,无论法律还是政策,在形式表达上都加大了对农村妇女土地权益的保障,然而保障的结果却与制度的预期有所偏差,主要是法律与政策在运行过程中,以家户为基础的法律制度遮蔽了农村妇女土地权益;村民自治规范劫取了农村妇女土地权益;民间风俗使农村妇女无视自己的土地权益;相关法律制度的粗陋使农村妇女土地权益流于形式。基于此,以三权分置法律构建为视角重构农村妇女土地权益保障体系;以个人本位为基点构建土地确权法律制度;以权责为基点完善村民自治规范合法性监管制度;以社会性别为基点构建农村妇女土地权益等。通过相关法律制度完善保障农村妇女的土地权益。
With the deepening of people's awareness of land scarcity and its asset nature, the number of disputes about rural women's land rights is on the rise. Through an inventory of existing laws and policies of protecting rural women's land rights and interests, it is found that both laws and policies have increased the protection of rural women's land rights and interests in form. However, the result is deviated from the expectation mainly because of the following reasons: the family -based legal system overwhelms the rural women's land rights and interests in the implementation process;the villagers' autonomous rule plunders the land rights and interests of rural women;the folk customs makes rural women ignore their land rights and interests;the humbleness of the relevant legal system makes rural women's land rights just exist in form. Based on this, from the perspective of the construction of three-right separation law, this paper reconstructs the land rights and interests security system of rural women from three aspects: construct a legal system of land right confirmation based on personal standard;improve the legal supervision system of villagers' autonomy norms based on rights and responsibilities;construct rural women's land rights and interests based on society sexuality. The land rights and interests of rural women lies in the improvement of laws.
