摘要
当前理论认为审前程序应由"控诉机关"检察院发挥一定作用,有将检察机关在刑诉程序中的地位一定程度上边缘化、附随化的倾向。审前检察权基本定位为司法权,是庭审实质化与审前司法审查、审前证据形塑的"最大公约数"。检察权作为审前助力证据裁判、制约侦查权的司法介入力量,发挥其实质作用,也成为当前最佳选项。而从唯物、历史、比较三个角度反思,印证了检察力量以司法审查、司法指导角色实质在审前发挥作用的合理性。也应看到检察前置介入若干可能机遇。鉴于此,审前检察介入侦查的重点应在"形塑证据"上,应助力提升刑事侦查"两个专业性",确立基本的介入理念,为后续制度发展打下基础。
The current theory holds that the pre-trial procedure should play a certain role by the "prosecution agency", but there is a tendency to marginalize and accompany the procuratorial organ’s position in the criminal procedure. The pre-trial procuratorial power is basically positioned as the judicial power, which is the "the greatest common denominator" for the substantive examination of the trial and the judicial review before the trial and the pre-trial evidence. As the pre-trial power evidence referee and the judicial intervention force that restrains the investigative power, the procuratorial power has played its substantive role and has become the best option at present. The reflection from the three perspectives of materialism, history and comparison confirms the rationality of the procuratorate’s role in judicial review and judicial guidance before the trial. There should also be a number of possible opportunities for prosecution intervention. In view of this, the focus of pre-trial inspection and intervening of investigation should be on "shaping evidence", which should help to improve the "two professionalism" of criminal investigation, establish basic intervention concepts, and lay the foundation for the follow-up system development.
