摘要
《快递暂行条例》公布实施,为快递业的转型提供了法律保障,快递服务规则得以进一步完善,快递企业与快递收件人之间的法律关系得以明晰。但针对快递服务中快递员未经收件人同意以智能快递柜进行快件投递的行为,立法与司法还需合力应对。
With the“Provisional Regulations on Express Delivery”was announced and implemented,the legal protection for the transformation of the express delivery industry was provided,and the rules for express delivery services were further improved,the legal relationship between the express enterprises and the recipients was clarified as well.However,for the act of the couriers deliver with smart parcel lockers without the consent of the recipients,the legislation and the judiciary still need to joint response.
