摘要
除了独创性,作品是否必须具备固定性是判断VR三维数字模型是否属于作品的关键。综观国外著作权立法实践,固定性并非必须必要。并且,作品的非固定性是目前理论通说。在数字时代,符合独创性标准的作品只要能够以可被外人感知的方式呈现即应为著作权法意义上的"作品"。VR三维数字模型异于创造性、艺术性要求均高于一般作品的美术作品。VR三维数字模型虽然形式上似于实用艺术品,却因其重视感官体验、缺乏实际功效而实质上并不属于实用艺术品。计算机程序的源代码、目标代码与VR三维数字模型保持一致。将VR三维数字模型归入计算机程序的范畴不仅符合法理,也符合著作权制度的利益平衡要求。
In addition to originality, whether a work must be fixed is the key to judge whether a VR 3d digital model is a work or not. In view of the practice of foreign copyright legislation, fi xedness is not necessary. Moreover, the non-fi xed element of the work is the current theory.In the digital age, works conforming to the standard of originality should be "works" in the sense of copyright law as long as they can be presented in a way that can be perceived by outsiders.The VR 3d digital model is different from art works with higher requirements on creativity and artistry than general works. Although VR 3d digital model is similar to practical art in form, it does not actually belong to practical art because it attaches importance to sensory experience and lacks of practical effects. The source code and target code of computer program are consistent with VR 3d digital model. The classification of VR 3d digital model into the category of computer program not only conforms to legal theory, but also meets the requirement of interest balance of copyright system.
