摘要
在中小学教师聘任制的实施过程中,出现了聘任权被滥用和流于形式的现象。在比较中外聘任教师做法的基础上,主张教师聘任权不能仅归属校长或教育局长单一主体,而应由多主体分享,以便权力抑制权力。教师聘任权应由各方代表组成的聘任委员会和校长分别行使。在聘任中,应实行决定权和签约权、实体权和程序权的分离。如果一个机构享有决定权,另一个机构就应有签约权。实体权应由集体行使,以保障聘任的公平和公正;程序权宜由个人享有,以体现聘任的效率和效益。
In the process of the implementation of the appointment system of primary and secondary school teachers,the phenomenon of abuse and formality of appointment right has arisen.On the basis of comparing the practice of employing teachers at home and abroad,it is argued that teachers'appointment right cannot belong only to the principal or the single subject of the director of education,but should be shared by multiple subjects in order to restrain power by power.The appointment right of teachers shall be exercised separately by the headmaster and the appointment committee composed of representatives of all parties.In the appointment,the separation of the right of decision and the right of contract,the right of entity and the right of procedure should be implemented.If an institution enjoys the right to decide,another body should have the right to contract.The right of entity shall be exercised collectively in order to guarantee the fairness of the appointment;the right of procedure is enjoyed by individuals in order to reflect the efficiency and effectiveness of the appointment.
