摘要
在贸易全球化背景下,气候贸易措施在应对气候变化上发挥着举足轻重的作用,但同时又经常处于多边贸易协议的"灰色地带"。许多国家以"例外规定"作为掩护,挑战多边贸易原则,影响多边贸易的有序进行。在对气候贸易措施以及多边贸易原则形成一个相对完整的认识基础上,文章分析了二者冲突缘由,并提出通过坚持共同且对称的责任、完善多边贸易体制规则和构建国际贸易与环境沟通平台的路径达到协调二者的目的,以保证气候贸易措施在应对气候变化发挥出应有作用的同时,不会对多边贸易的公平有序进行造成消极影响。
Under the background of trade globalization, climate-related trade measures play a decisive role in coping with climate change, but at the same time, they are often in the “gray area” of multilateral trade agreements. With the “exception” as a cover, many countries challenge multilateral trade principles and affect the orderly conduct of multilateral trade. This paper forms a relatively complete understanding of the climate-related trade measures and the multilateral trade principles in order to analyze the cause of contradiction. By adhering to common and symmetrical responsibilities, improving the rules of the multilateral trading system and building a common platform for international trade and environment, the goal of coordinating the two parties can be achieved. It is to ensure that the climate-related trade measures play an important role in coping with climate change and will not have a negative impact on the fair and orderly conduct of multilateral trade.
